READ THIS AGREEMENT CAREFULLY.

BY SUBMITTING THIS FORM, YOU ARE ASSUMING RISKS AND GIVING UP CERTAIN LEGAL RIGHTS.

1. Scope of the Event. The Event includes check-in, safety briefings, hunting and shooting activities, walking or standing in fields and other areas of the property, use of guides or hunting dogs when applicable, transportation or movement on the property, and other activities reasonably related to the pheasant hunt.

2. Firearms and Hunting Risks. I understand that hunting and the use of firearms are inherently dangerous activities. Risks include, but are not limited to: loading, unloading, carrying, handling, and discharging firearms; accidental or unintended discharge; shots fired by me or by others; ammunition, shot, debris, or ricochets; firearm or equipment malfunction; hearing damage; and the actions, errors, or judgment of other participants. Some risks may be unknown, hidden, or unforeseen. I knowingly and voluntarily accept and assume these risks.

3. Field, Property, Animal, and Weather Risks. I understand that the Event also involves risks not directly related to firearms. These may include uneven or rough terrain; holes, ditches, mud, ice, snow, tall grass, brush, crops, fences, gates, natural or man-made objects; slips, trips, and falls; buildings and other structures; vehicles and equipment; changing or severe weather; and encounters with animals, including hunting dogs. Dogs may run, jump, collide with people, or bite. I knowingly and voluntarily accept and assume these risks, including risks that may be unknown, hidden, or unforeseen.

4. My Safety Responsibilities. I will use good judgment and exercise care for my own safety and the safety of others. I represent that I am legally permitted to possess and use any firearm I bring or use during the Event and that I am familiar with its safe operation. I will follow all applicable laws, hunting regulations, property rules, safety instructions, and directions from Zwickey’z Pheasant Farm staff, guides, landowners, or representatives. I will not participate while impaired by alcohol, illegal drugs, or any substance that makes firearm use unsafe. I will immediately report any unsafe condition, injury, or firearm problem and will stop participating if instructed to do so.

5. Release of Negligence Claims. To the fullest extent permitted by law, I release and agree not to hold liable Zwickey’z Pheasant Farm and its owners, officers, directors, employees, agents, guides, dog handlers, volunteers, representatives, affiliated persons or entities, and landowners on whose property the Event takes place (collectively, the "Released Parties") for loss, property damage, personal injury, or death arising out of or related to my participation in the Event when such loss, damage, injury, or death results from ordinary negligence. This release does not apply to intentional misconduct or reckless disregard for the safety of others. I understand that I am giving up the right to bring an ordinary-negligence claim against the Released Parties for risks covered by this Agreement.

6. Responsibility for My Conduct. I am responsible for losses, damages, injuries, costs, or expenses that I cause through my own negligent, reckless, or intentional conduct; violation of law or hunting regulations; violation of Event safety rules or instructions; or unsafe or improper handling or use of a firearm. Nothing in this paragraph makes me responsible for losses caused solely by the conduct of another person.

7. Medical Care and Personal Property. If I am injured or become ill during the Event, I authorize reasonable emergency assistance to be obtained for me when circumstances require it. I understand that I remain responsible for my own medical expenses and for safeguarding my personal property, except to the extent otherwise required by law.

PARTICIPANT INFORMATION
